Introduction

Pairwise Technologies LLC ("Pairwise," "we," "us," or "our") operates the pairwise.ai website and provides an AI-powered technical hiring platform and related services (collectively, the "Services"). We are committed to protecting your privacy and being transparent about how we handle personal information.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our website, communicate with us, or use the Services. Your use of the Services is also governed by our Terms of Service. If you have any questions, contact us at support@pairwise.ai.

1. How This Policy Applies: Our Role

Our responsibilities depend on the context in which personal information is processed.

Candidate workflows (we act as a processor / service provider). When we provide the Services as part of an employer's or staffing firm's hiring process — for example, generating or analyzing interviews, evaluating candidates, or processing resumes — the employer or staffing firm (our "Customer") is the controller of that candidate information. Pairwise processes it on the Customer's behalf and under our contract with the Customer, and only to provide the Services. The Customer's own privacy policy governs its hiring decisions, retention, and downstream use of a candidate's record.

Website, marketing, and account data (we act as a controller). For information collected through our website, our communications with you, and administration of Customer accounts, Pairwise acts as a controller.

If you are a candidate and want to exercise privacy rights regarding your candidate record, those requests generally should be directed to the Customer running the hiring process (see Section 9).

2. Information We Collect

The information we collect depends on how you interact with us.

Information you provide to us. When you register, express interest in our products, or contact us, we may collect your name, business contact information (such as email address and phone number), account credentials, billing and payment information, and any information you choose to provide in your communications with us. All information you provide should be true, complete, and accurate, and you should notify us of changes.

We do not collect Social Security numbers, and we do not collect or process biometric data (such as voiceprints, facial geometry, identity-verification imagery, or gaze/attention proctoring).

Candidate workflow information (processed on behalf of a Customer). Depending on the Customer's configuration, we may process information relating to candidates, including name and contact details, resumes and employment history, interview questions and responses, interview recordings and transcripts, and automated outputs such as summaries, structured notes, and evaluations generated by the platform.

Google Workspace data. Our platform allows you to connect your Google account to simplify account creation and enable scheduling. When you connect your Google account, we collect your name, email address, and profile picture to populate your user profile, and we access your Google Calendar to create, view, and edit events related to job evaluations and interviews, solely to facilitate scheduling between employers and candidates.

Pairwise's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. We do not use Google user data for advertising or for any purpose other than providing the core functionality of the platform.

Information collected automatically. When you use the Services, we automatically collect technical and usage information that does not by itself identify you, such as IP address, browser and device characteristics, operating system, language preferences, referring URLs, general location, and information about how and when you use the Services. We use cookies and similar technologies for core functionality, security, and understanding usage; where required, we provide cookie controls, and you can also manage cookies through your browser.

3. How We Use Information

As a controller (website, marketing, and account data), we use personal information to:

  • facilitate account creation and login;
  • provide, operate, maintain, secure, and improve the Services;
  • send administrative and service-related communications;
  • fulfill and manage orders, billing, and payments;
  • respond to inquiries, requests, and support needs;
  • request feedback and understand how the Services are used;
  • generate de-identified or aggregated data (see below); and
  • detect, prevent, and address fraud, abuse, and security incidents, and comply with legal obligations.

As a processor (candidate workflows), we use candidate information only to provide the Services in accordance with the Customer's instructions and our contract with the Customer — for example, to generate transcripts, summaries, and evaluations the Customer has configured, and to maintain the security and integrity of the Services.

AI model training. We do not use identifiable candidate or Customer data to train, fine-tune, or improve our AI models. We may create and use de-identified and/or aggregated data derived from use of the Services to analyze, maintain, and improve the Services. Such data is maintained in a form that does not identify you or any individual.

4. How We Disclose Information

We do not sell personal information. We disclose information only as needed to provide and protect the Services:

  • To the Customer. For candidate workflows, we provide interview results, outputs, and related information to the Customer running the hiring process.
  • To service providers and subprocessors. We use vetted vendors (for example, hosting, communications, and analytics) to support the Services. These vendors are contractually restricted to using information only to provide services to Pairwise and only as needed for those services.
  • For legal and safety reasons. We may disclose information where required by law or legal process, or to protect the rights, safety, or property of Pairwise, our Customers, candidates, or others.
  • Business transfers. If Pairwise is involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to appropriate safeguards.
  • With your consent or at your direction.

Note on Google data. Notwithstanding anything else in this policy, we do not share Google user data with third parties except as necessary to provide platform features, to comply with law, or as part of a merger or acquisition. We never sell Google user data.

5. Data Minimization and Retention

We limit collection, use, disclosure, and retention to what is necessary to provide the Services, protect the platform, and comply with law.

For candidate workflows, retention is primarily governed by the Customer's instructions and our contract with the Customer; we retain such data only as needed to provide the Services and comply with legal obligations. For website, account, and communications data, we retain information only as long as necessary for the purposes described in this policy, considering the duration of the Customer relationship, legal and accounting obligations, and applicable limitation periods for claims.

6. Third-Party Integrations

The Services may allow you to connect third-party accounts and integrations, such as Google, LinkedIn, or applicant tracking systems. You can revoke access to any third-party integration at any time through your account settings or the third party's security page. For Google specifically, you may revoke access via the "Security" or "Profile" settings in your Pairwise account or through your Google Account security settings; upon revocation, we will stop accessing your Google data and delete stored OAuth tokens from our servers. We are not responsible for the privacy practices of third-party services, and we encourage you to review their policies.

7. Security

We use administrative, technical, and physical safeguards designed to protect personal information. However, no system can be guaranteed completely secure, and we cannot guarantee the absolute security of your information.

8. International Data Transfers

The Services are hosted in the United States. If you access the Services from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States and other countries whose data-protection laws may differ from those in your jurisdiction. Where required, we implement appropriate safeguards for international transfers, such as Standard Contractual Clauses.

9. Your Privacy Rights

Depending on where you live and applicable law (including the GDPR/UK GDPR and the CCPA/CPRA), you may have rights to access, correct, delete, or receive a portable copy of your personal information; to restrict or object to certain processing (including direct marketing); to opt out of the "sale" or "sharing" of personal information (we do not sell personal information); and to withdraw consent where processing is based on consent. You may also have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects, and the right to lodge a complaint with a supervisory authority.

Candidate requests. Because the Customer is typically the controller for candidate data in hiring workflows, requests to access, correct, or delete a candidate record should be directed to the Customer. If you send such a request to Pairwise, we will either act on the Customer's behalf in accordance with their instructions, or let you know that the request should be directed to the Customer.

Other requests. For information we control (such as website or account data), you may contact us at support@pairwise.ai. We may ask you to verify your identity before acting on a request. There may be exceptions and limitations to these rights under applicable law.

10. Legal Bases (EEA / UK Users)

Where the GDPR or UK GDPR applies and we act as a controller, we process personal information on one or more of the following legal bases: your consent; performance of a contract or steps taken at your request prior to entering a contract; compliance with a legal obligation; and our legitimate interests (such as securing, analyzing, and improving the Services), provided those interests are not overridden by your rights.

11. EU AI Act Transparency (EEA Users)

Where the EU AI Act applies: our systems intended to interact directly with individuals are designed so that you are informed you are interacting with an AI system, unless obvious from context. The Services may produce outputs that assist Customers in recruitment and evaluation. Customers deploying such outputs in employment contexts may have their own obligations as deployers of high-risk AI systems, including informing affected individuals and, in applicable cases, providing meaningful explanations of the role of AI in decisions.

12. Children's Privacy

The Services are intended for users who are at least 18 years old. We do not knowingly collect personal information from children under 18. If you believe a child under 18 has provided us personal information, please contact us at support@pairwise.ai and we will take steps to delete it.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be indicated by a revised "Last updated" date and will be effective when posted. We may provide additional notice of material changes where appropriate.
